What is the problem with CBD flowers?

CBD flowers can easily be confused with THC flowers, which are illegal in Germany.  They are from industrial hemp, and other unprocessed CBD products do not appear to be legal as things stand. 

Although Germany has enacted its own forward-thinking marijuana legislation, it remains largely influenced by the European Union's policies, which are relatively stringent regarding hemp and maintain a prohibitory approach towards marijuana.

Can I grow CBD legally?

It is illegal to cultivate CBD with higher than 0.3% THC level in Germany. If one is caught, the same penalties as the offenders who sell or supply to the public are enacted. 

Only certified farmers are allowed to grow a specified selection of hemp varieties under certain conditions. Those who plan to plant for hobby purposes should rethink their decision as it is strictly prohibited in Germany.

Can you sell CBD in Germany?

Yes, as long as it adheres to the less than 0.3% THC content.

Selling and supplying cannabis in Germany with a higher THC content is considered a more serious offense. An offender could face up to five (5) years in prison. If there are aggravating circumstances, it could even increase to 15 years.

Can you import cannabinoids into Germany?

Yes, provided that the products have less than 0.3% THC. For medicinal CBD, you have to have authorization from the German Medicinal Product Act. Patients who suffer from certain conditions can have access in the form of dried blossoms or extracts only if they have a doctor’s prescription.  CBD products with higher THC levels for medical purposes can also be obtained with a prescription from a doctor.
